Regulations of the "Bendlyfe" Online Store

§ 1 Definitions

The following definitions apply in these regulations:

  1. Seller - means Marta Ulanecka-Kaczyńska Bendlyfe with its registered office at ul. Wielicka 42/B3 30-552 Kraków, with NIP 6312537405 and REGON 526416526.
  2. Customer - means a natural person, a legal person or an organisational unit that is not a legal person, which is granted legal capacity by special provisions and who places an order in the Store.
  3. Consumer – a customer who is a natural person and meets the criteria specified in the definition in Art. 22[1] of the Civil Code, being a natural person performing a legal transaction with an entrepreneur, not directly related to his business or professional activity.
  4. Online store (Store) - website available at www.bendlyfe.com, enabling customers placing orders.
  5. Regulations - this document is specifying the conditions of use of services provided electronically within the "Bendlyfe" online store (www.bendlyfe.com).
  6. Goods – sports products and accessories presented on the Store's website.
  7. Order – indicates the Customer's declaration of will aimed at concluding a Sales Agreement, containing information, among others: about the type and quantity of the ordered Goods.
  8. Sales contract - a contract for the sale of Goods in accordance with the provisions of the Civil Code, concluded between Marta Ulanecka-Kaczyńska Bendlyfe and the Customer, using the services of the Store.
  9. Civil Code - refers to the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
  10. Act on Consumer Rights - refers to the Act of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827).
  11. Act on the provision of services by electronic means - refers to the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).

§ 2 General Provisions

  1. The Regulations specify the conditions for using the offer of the "Bendlyfe" online store, available at www.bendlyfe.com.
  2. The "Bendlyfe" online store is run by Marta Ulanecka-Kaczyńska Bendlyfe with its registered office at ul. Wielicka 42/B3 30-552 Kraków, with NIP 6312537405 and REGON 526416526.
  3. To use our online store, it is necessary to meet the minimum technical requirements of the IT system used. Is it required to:
    • Use a browser that supports JavaScript. Acceptable browsers include: Internet Explorer (version 10 or later), Chrome (version 49 or later), Firefox (version 43 or later), Microsoft Edge (version 13 or later), Opera (version 36 or later), and Safari (version 4 or later) .
    • Have a minimum screen resolution of 480 x 680 pixels.
  4. In accordance with applicable law, the Online Store reserves the right to limit access to its services only to persons over 18 years of age. In this case, potential customers will be informed accordingly.
  5. Each Customer has the right, at any time, to download and print these Regulations, available at the link: Regulations of the Bendlyfe Online Store.
  6. The regulations include:
    • The procedure for registering and using an account in the Store.
    • Electronic ordering procedure.
    • Rules for concluding sales contracts using the services offered by the Online Store.

§ 3 Procedure for concluding the Sales Agreement

  1. Information about the Goods available on the Store's subpages is for information purposes only and includes product descriptions, their technical and operational parameters and prices. They do not constitute an offer within the meaning of Art. 71 of the Civil Code.
  2. By purchasing specific Goods, the Customer declares that one has read the content on the product card and accepts it.
  3. To select a Good for purchase, the Customer should add the product to the cart.
  4. When placing an Order - until one clicks the "Pay now" button or another equivalent option informing about the obligation to pay, the Customer may make changes to the entered data and the selected Goods. In order to make such changes, please follow the information and messages displayed to the Customer on the website.
  5. After the Customer has entered all necessary data in the Online Store, a summary of the order will be displayed. This summary will include information about:
    • order content,
    • the unit and total cost of the ordered Goods, including delivery costs and additional fees (if any),
    • selected payment method,
    • preferred delivery method,
    • planned delivery date.
  6. To finalize the order, the Customer must click the "Pay now" button. Sending the order constitutes the Customer's expression of will to conclude a Sales Agreement, in accordance with the provisions of the Regulations, between the Customer and Seller.
  7. After placing the order, the Customer will receive an e-mail entitled "Order [order number] confirmed", which will contain final confirmation of the contents of the order.
  8. The contract is considered concluded from the moment the Customer receives the above-mentioned e-mail. All terms of the contract and general rules (in accordance with the Regulations of the online store) will be recorded, secured and made available via e-mail. The contract will be drawn up in English.

§ 4 Delivery

  1. Delivery of products covers the territory of the Republic of Poland and certain European Union countries, which can be selected in the registration form available on our website. The products will be delivered to the address indicated by the Customer when placing the order.
  2. Delivery of ordered Goods in Poland is carried out using courier services such as Inpost and DPD, as well as by using Inpost parcel lockers. The delivery of ordered Good in specified EU countries is carried out by DPD. Delivery costs will be presented to the Customer when placing the order.
  3. The shipping time of sending Good by Seller to Customer is maximum 7 days, excluding holidays specified in this regulation.
  4. Holidays with a shipping break: November 25th - December 3rd, 2023.
  5. The delivery time of the Goods to the Customer differs by the shipping company and can be maximum 30 days.

§ 5 Prices of Goods and payment options

  1. Product prices are expressed in Polish zlotys/ euros and include VAT.
  2. The customer can make a payment via:
    • PayPal
    • Transfers 24

§ 6 Withdrawal from the sales contract

  1. The Customer who is also a Consumer is entitled to a 14-day period in which he may withdraw from the contract without giving a reason. This period expires after 14 days from the date of receipt of the product or from the date on which a person other than the carrier and indicated by the Customer came into possession of the Goods.
  2. To exercise the right to withdraw from the sales contract, please inform us, the Seller, via a message containing an unambiguous declaration of return from the contract. This can be done by sending such a declaration by post or e-mail to info@bendlyfe.com.
  3. In order to meet the deadline for withdrawal from the contract, it is sufficient for the Customer to send a declaration of withdrawal from the contract before the expiry of the 14-day withdrawal period.
  4. When withdrawing from the contract, the goods must be intact, without traces of use, in the original packaging, along with any additions and accessories (if they were attached to the product). Free items should also be returned.
  5. Please note that the right to withdraw from the contract does not apply if the product is adapted or personalized to the Customer's specifications or is closely related to the Customer. Information regarding such products is available in the product description. When making a purchase, the Customer accepts these conditions.
  6. In the event of withdrawal from the contract, it is considered not concluded and all services provided by the parties are refundable.
  7. If the consumer decides to withdraw from the contract in accordance with the rules described, he is obliged to return the products covered by the contract within a period not exceeding 14 calendar days from the date of receipt of the goods (counting from the date of sending the parcel), unless the store agrees to a different deadline.
  8. The store undertakes to immediately, no later than within 14 calendar days from the date of receipt of the consumer's declaration of withdrawal from the contract, refund all payments made by the customer, excluding delivery costs.
  9. The store will refund the payment using the same payment method used by the consumer, unless the customer agrees to a different method of return that does not generate additional costs for him.
  10. The customer bears all costs of returning the product to the store, unless the store agrees to a different return method.

§ 7 Consequences of withdrawal from the contract

  1. If you withdraw from this contract, we undertake to refund all payments received from you, excluding the costs of delivery of the goods, immediately and in any case no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. The refund will be made using the same means of payment that you used for the original transaction. In the event of withdrawal from the contract and reimbursement of the costs of the Goods, you will not incur any fees in this respect.
  2. We may withhold reimbursement until we receive the products or until you provide us with proof of return, whichever occurs first.
  3. Please send us the Goods for return immediately, no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline will be met if you return the item within 14 days. You bear the costs of returning the Goods yourself. You are only responsible for any reduction in the value of the products resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the products.

§ 8 Complaints

  1. Seller is liable to the Customer who is a Consumer, in accordance with the provisions of the Civil Code, and in particular in the scope of warranty for defects referred to in Art. 556 and art. 556[1] - 556[3] and further provisions of the Polish Civil Code.
  2. In the event of complaints arising from a violation of rights guaranteed by law or under these Regulations, please send them to info@bendlyfe.com. We undertake to consider each complaint within no longer than 14 days.

§ 9 Complaints regarding the provision of electronic services

  1. Our online store makes every effort to ensure the proper functioning of the website and the Store's websites. We operate in accordance with the latest technical knowledge and undertake to remove any technical faults reported by our clients as soon as possible.
  2. If you notice any irregularities related to the operation of the website and websites of our store, we encourage you to report them in writing to the following address: Marta Ulanecka-Kaczyńska Bendlyfe, ul.   3. In the complaint, please provide as detailed a description as possible of the type of irregularity and the date when problems related to the operation of our store occurred. Your feedback is extremely valuable to us.

§ 10 Dispute resolution and final provisions

  1. Our Customers who are Consumers have the opportunity to use out-of-court means of resolving disputes and pursuing their claims. In the event of disputes related to online purchases, there is an option to use mediation proceedings conducted by the Provincial Inspectorate of Trade Inspection or to resolve the case through an arbitration court at the Provincial Inspectorate of Trade Inspection.
  2. Consumers also have the right to choose other available methods of out-of-court dispute resolution. One of them is the possibility of submitting a complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.
  3. In matters not specified in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply. We are ready to cooperate and solve any problems in the spirit of cooperation and respect for applicable law.
